CSM PRIVACY POLICY

Introduction
The Canadian Ski Marathon Incorporated (“CSM”) is committed to safeguarding the personal information entrusted to it by its skiers. It only collects personal information required for the purposes of registration, for providing services to its skiers for its annual cross-country ski event, for publishing the names of registered skiers and their results on its website, for publishing photos of the event and the skiers on its website, and for operating its on-line store. This policy describes the data we collect, why we collect it, how we collect it, who has access to it, how we protect it and how you may view or edit it, in accordance with the Loi sur la protection des renseignements personnels dans le secteur privé (Law Respecting the Protection of Personal Information in the Private Sector (Quebec) and other applicable laws.
When we use the term “we”, we mean the CSM. When we use the term “you”, we mean the skier. When we use the term “personal information” we mean any data that identifies you or makes you identifiable as a natural person. We control the processing of your personal data once we receive it from third-parties. If you wish to contact us, see the information at the end of this document.
Scope and Consent
By accessing our website, communicating with us, registering for events, or making purchases through our online store, you agree to the terms of this Privacy Policy and consent to the collection, use, and disclosure of your personal information as described herein.
What personal information do we collect and who collects it?
We collect the following types of personal information:
- Communication with us – When you communicate with our office, we collect the information you provide to us such as your name, email address, phone number, mailing address and any other information you include in order to deal with your inquiry.
- Website – When you visit our website, we do not collect personal information such as your name or email address. Our website provider may collect information such as IP address, network file system, access times, domain name, browser type and device, device ID, uniform resource locators, operation system, language preferences and information on your usage of the website, pages visited, time accessed and cookie data in order to provide us with analytics. You can manage your cookie preferences through the pop-up window on our website and your browser settings. While we may have access to that data, we do not collect it separately from our provider. - Newsletter – When you visit our website, you may choose to provide us with your email address so we can add it to our newsletter system, which uses MailChimp to send emails. When you register for our event, you have the option of asking us to add your email address to the newsletter system.
- Registration – When you register for our annual events, you use the on-line system provided to us by a third party – Zone4 Systems Inc in Canmore, Alberta. They collect your personal information, subject to their privacy policy, which they then provide to CSM. It includes your name, gender, birthdate, age, language preference, address, email address, permission to add your email address to our newsletter system, home and cellular phone number, person to contact in case of emergency, their phone number, medical information you choose to give us in case of emergency, acknowledgment of the course direction, consent to our refund and event cancellation policies, skiing category, team name, club name, choice of CSM dormitory accommodation, choice of CSM inter-city bus, bib pickup location, donation to offset greenhouse gases, choice of Sunday meal, donation, and consent to the Nordiq Canada and CSM waivers. While you pay fees using your credit card and provide the credit card number to Zone4, CSM only has access to the last four digits of the number and the “token” (credit card tokenization is a security method that replaces sensitive credit card information with a unique, randomly generated string of characters called a “token”) so that we may process extra charges or refunds to your card. The payment is processed through CSM’s merchant bank – Helcim Inc – who can see your name, credit card type and number. In the Helcim system, CSM can only see your name, credit card type and part of the number.
- During the event – When you ski in our annual event, we record the time you start and finish each of the ten sections of the trail using a Zone4 timing chip that we provide to you. We require this to know how many and which skiers are on the trail at any point in time for safety purposes. This information is collected by Zone4 and made available to us.
- Photographs, audios and/or videos – When you ski in our annual event, we take photographs and videos of skiers and volunteers that may include your face, bib number, and your first name if it is printed on your bib. When you registered for the event, you signed a waiver giving consent for us to take your photograph and publish it.
- On-line store – When you order merchandise from our on-line store, you provide us with your name, email address, mailing address and phone number. The payment system is provided by a third party – Square. You provide Square with your credit card and CSM only has access to the last four digits of the number and the “token” so that we may process extra charges or refunds to your card.
- Newsletter – When we send a newsletter by email using MailChimp, we are able to see if you opened it, if you clicked on a link or if you unsubscribed?
- Skier survey – If you respond to the skier survey we send out after each event, you have the option of providing your email address and other identifying information.
- Job application – When you apply for a job with us, you provide us with personal information including your work experience and education. We may choose to perform a background check that may provide us with additional personal information.
- Social media (e.g. Facebook, Instagram) – When you interact with our social media pages, we may receive information from those social networks including your profile information, picture, user ID associated with your social media account, friends list, and any other information you permit the social network to share with third parties. The personal data we receive is dependent upon your privacy settings on the respective social media platforms.
How do we collect your personal information?
We collect the personal information using one of these methods:
- You provide it to us – Most of the personal information we receive comes to us voluntarily from our skiers in the course of using our services, such as communicating with us, subscribing to our e-mail newsletter, registering for our event, or purchasing from our on-line store. You are free to choose which information you want to provide to us or whether you want to provide us with personal information at all. However, when registering for our event, all of the information requested is required. If you do not want to provide it on-line, contact our office to explore other options. If you want to order merchandise without going on-line, contact our office.
- Photography/Videographer – The CSM photographer/videographer takes photos of skiers throughout the event, including at checkpoints and along the trail.
- Collected using technology – As you use our website or receive email from our newsletter system, we may collect information through the use of cookies and similar technologies.
- Provided by others – We may receive personal information about users from third parties such as social media sites, data enhancement services and law enforcement agencies.
Why do we collect your personal information:
Your personal information is collected for the following purposes:
- To provide customer service and to respond to inquiries
- To process and manage event registrations
- To communicate event details and updates (this may be done throughout the year, independently of our actual event taking place)
- To ensure safety during the event (e.g., medical info and skier tracking)
- To process online purchases and ship merchandise
- To process your job application request
- To improve our website and services
- To inform you of our annual general meeting
- To inform you of future events
- To comply with legal and regulatory obligations
We will only use your personal information for the purposes for which we have collected it. We will not sell or give any of your personal information to third parties for them to market to you.
Who has access to your data?
The following people or organizations have access and require access to some or all of your personal information:
- The data provided when you communicate with our office is seen by our client services staff. They may choose to share it with the Event Director or a few Directors (board members) and volunteers whose help might be needed to deal with your inquiry.
- All of the personal information you provide during registration can be seen by staff at Zone4, by CSM staff (client services, Event Director) and by a few of the Directors and volunteers involved in the registration and results processes. Some of the data can be seen by our payment processor, marketing consultant, accountant, and auditing company.
- Various lists with various combinations of your first and last name, age, gender, language, skiing category, bib and chip number, choice of dorm, bus and bib pickup location, dinner choice are given to staff and lead volunteers at the dormitories and checkpoints.
- A list with first and last name, age, gender, language, skiing category, home and cell phone, person to contact in case of emergency and their phone number, and medical conditions is given only to the safety contractor and lead radio operators.
- Lists with your name, city, postal code, year of birth, gender and club name are given to Ski de Fond Quebec and Nordiq Canada for insurance purposes.
- The timing data obtained when you start and finish each section is collected by Zone4 and provided electronically to CSM. It is seen during and after the event by the safety contractor, the Event Director and the few Directors and volunteers involved in handling this data. It is studied after the event by the volunteer who determines the results and awards.
- Identifying information that you might provide when you respond to our skier survey is seen by the one Board member who administers the survey. When the results of the survey are distributed to other Board members and staff, no information is included that connects comments to a specific person.
- Information about your visit to our website, but not your name, can be seen by our internet service provider and IT consultant.
- Personal information may be disclosed to third parties as required by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our legal claims or to protect the security or integrity of our services; and/or (c) to exercise or protect the rights, property, or personal safety of CSM, our partners, employees, or others.
Where do we publish some of your data?
- When you register for an event, we publish your name, city, province or country, club name, gender and skier category on our website. This information remains on the website until replaced for the following year’s event. If you wish not to be listed here, please inform our office.
- When you cross the finish line, we announce your name, age, city, and skier category over loud speakers.
- On the day of the event, a public link distributed in the Skiers Guide and to all skiers by email will lead to a live report on the Zone4 website with the name and the time of day that each skier started and finished each section of the marathon.
- After the event, we publish on our website your name, gender, age, city, province, bib number, club on separate pages for the individual results (number of sections completed), individual awards, team awards, special awards and permanent bibs (a list of all CdB Legends and Weber Awards). Some of this information remains on the website for a few years and some of it remains indefinitely.
- On our website, we publish the photos taken during the event. Skiers sign a consent when they register for their photo to be taken and published.
Children’s Privacy
The CSM event is open to children under the age of 14 provided they are accompanied by an adult. Registration requires use of credit cards, which are not available to children. We collect the personal information from children under the age of 14 only with the consent of a parent or legal guardian, in compliance with Quebec law.
How do we protect the personal information?
We implement a variety of security measures to maintain the safety of your personal information when you use our services. However, no system of security can be 100% secure and so we cannot guarantee in all cases the security of the information that we process. In the event we learn that personal information is compromised as a result of a breach of security, we will take steps to investigate and comply with notification obligations and take other steps in accordance with applicable laws and regulations.
Depending on the volume and sensitivity of the information, the purposes for which it is used and the format in which it is stored, we implement a combination of measures to protect your personal information, including:
- A privacy framework governing the protection of personal information through its lifecycle. This framework defines the roles and responsibilities of CSM personnel, provides a process for dealing with complaints regarding the protection of the information, and addresses the retention and destruction of personal information.
- Internal policies and procedures that define the roles and responsibilities of our employees throughout the information life cycle and limits their access to such information on a “need-to-know” basis.
- If information is collected or stored in electronic format, technical safeguards such as encryption, firewalls, passwords, antivirus software and similar measures.
- A designated Privacy Officer to monitor CSM’s compliance with applicable privacy laws.
- Employee privacy and data security training.
All of the data we collect is stored electronically. We do not maintain printed files.
Registration and timing data is stored by Zone4 on their computer systems subject to their privacy and security policies. Access to their databases requires an authorized username and password. Access to these databases is only granted to CSM staff, directors, contractors, volunteers and people who have a need to know.
Personal information is exported from Zone4 to spreadsheets managed by CSM personnel and is stored on their personal computers. All of these computers operate with firewalls and all files with personal information are password-protected.
Immediately after each event, all skier lists that were distributed to lead volunteers (checkpoints, dormitories, etc.) and the safety contractor are destroyed.
Do we conduct cross-border transfers of personal information?
CSM is based in Canada. Some of our service providers may access, process or store your personal information outside of the country where we are located and where you reside, including in Canada and elsewhere. We store data in Google Drive and they store it in servers around the world. As a result, when your personal information is used or stored in a jurisdiction other than where you are residing, it may be subject to the law of this foreign jurisdiction, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction.
Your Rights:
Under Quebec law, you have the right to:
- Access your personal information
- Request corrections to inaccurate or incomplete data
- Withdraw your consent at any time
- Request the deletion of your personal information (subject to legal exceptions)
- File a complaint with the Commission d’accès à l’information (CAI)
- Please note that in some cases, at the time of collection of your personal information, we may provide you with additional information regarding the processing of your personal information. We may also, in certain circumstances, obtain your specific consent to the use or sharing of your personal information, including where required by law.
How can you access and amend your personal data?
Skiers are not able to access databases to view or amend their personal information by themselves. If you wish to view the data, amend it, if you wish your data removed from a published page on the website, or if you have any concerns, please contact the office.
If you subscribed to our newsletter system, you may unsubscribe by clicking on the unsubscribe link at the bottom of the newsletter or by contacting our office.
How long do we retain your personal information?
We will keep your personal information for the period necessary to fulfil the purposes described in this Privacy Policy, unless a longer retention period is permitted or as required for our business purposes or by law. Once no longer required, your personal information will be securely destroyed or anonymized in accordance with legal requirements.
Changes to This Policy:
We may update this Privacy Policy from time to time to reflect legal or operational changes. The updated version will be posted on our website and registration pages with the effective date.

What about other tracking technologies, like web beacons?
Cookies are not the only way to recognize or track visitors to a website.
